We are La Force International, also known more simply as LFI. This privacy notice is to let you know how we promise to look after your personal data. This notice explains how we do this and tells you about your privacy rights and how the law protects you.

2. Protection of your personal data

Customers, suppliers and business associates are entitled to expect La Force International to treat their data with due care. La Force International has developed a privacy policy that is in line with the (European) General Data Protection Regulation (GDPR). La Force International ’s privacy policy is implemented through agreements, rules of conduct and (security) measures. At La Force International we implement the GDPR throughout our company, it does not matter if your contact us while living in Europe, Asia, Australia the United states or Africa, we apply the same GDPR rights to everybody.

4. Purposes

Generally, La Force International will only collect personal information when it is provided voluntarily by you such as when you fill in a form to subscribe to our newsletters or send a request to La Force International  for information about our products or services. La Force International processes this personal data for various purposes, such as:

·       Performance of the contracts and agreements with La Force International suppliers and customers

·       Good and efficient service provision and business operations

·       Performing administrative acts

·       Maintaining contact

·       Customer relationship management

·       Improving service to its customers

·       Collecting funds and taking collection measures

Although you are able to visit and use the La Force International website anonymously, if you wish to take advantage of some of the services that are offered through the website then you may need to provide personal information to us (e.g. in our contact forms).

La Force International only uses personal data on the basis of legal processing grounds. For example:

La Force International may use your personal information for the performance of a contact between you and La Force International.

La Force International processes certain personal data in order to comply with a legal obligation. In addition, La Force International is subject to a number of statutory obligations in its business operations, such as verifying the identity of clients in the context of the Money Laundering and Terrorist Financing Laws.

If personal data are processed on the basis of permission, this will be requested separately at the moment the data is given to La Force International.

7. Provision to third parties

La Force International may exchange personal data as part of its services. La Force International may use the services of third parties for the aforementioned purposes, such as the IT suppliers of our website and our systems, organizations for archive management, specialized advisors and other service providers, logistics or OEM’s. In this context, personal data will be provided to these third parties. These third parties may only process your personal data for the aforementioned purposes and not for their own purposes. La Force International only makes use of third party services if they are in compliance with the GDPR.

Also, your personal data may be provided to third parties if La Force International is required to comply with a legal obligation. This may be the case, for example, with inspections by the Tax and Customs Administration, or other government watchdog agencies. If third parties must or may necessarily have access to your personal data, a processing agreement will be concluded where necessary, in which the agreements will be laid down that guarantee the correct and safe processing and confidentiality of your personal data. This happens in the EEZ as well as outside the EEZ.

8. Provision to other La Force International member firms and data transfer outside the EEA

Personal data may be transferred across borders to other parts of the La Force International network or to third parties for the purposes described above. The foregoing may also mean that personal data may be transferred to countries or regions without legislation protecting personal data equivalent to that enjoyed by visitors to the website in their country of origin. In such cases, La Force International  will take appropriate measures in each case, so that in a situation in which such a transfer of data takes place, such a transfer of data will always take place in a way that provides an “adequate level of protection”. This is done by making processing agreements with the third parties involved.

9. How La Force International secures your data

La Force International believes it is important that your personal data is protected against loss or unauthorized access. La Force International has therefore taken appropriate security measures at a level that is necessary in view of the nature and volume of the personal data to be processed. Furthermore all La Force International employees have a duty of confidentiality and are only allowed to process personal data as required for their work.

La Force International employs the following security measures:

·       virus and threat detection;

·       live and pre-delivery scanning of documents;

·       public credential leak monitoring.

10. Security breach

Despite all technical and organizational security measures, a breach (data breach) can never be completely ruled out. La Force International has set up a dedicated email address that allows employees and suppliers to report incidents that may involve a data leak.

As required by law, a data breach that could have serious consequences for data subjects is reported to the Privacy Regulator and, if required, to the persons whose personal data are involved in the data breach.

11. How long La Force International stores your data

La Force International will not process your personal data for longer than is necessary for the purposes stated in this privacy statement. This means that your personal data will be kept for as long as they are needed to achieve the purposes in question. Certain data must be kept longer, because La Force International has to comply with legal retention obligations, such as the retention obligation for tax purposes. For a complete list we refer to chapter 6 of this statement.

12. Your rights

At La Force International we like to be transparent, all the rights you as a data subject enjoy regarding the GDPR are honored by La Force International. These rights are explained below.

Information

You have the right to be informed of the existence and purpose of processing before your personal data is processed.

Access

You can request access if you think that La Force International is processing your personal data. La Force International will then notify you whether or not it is processing your personal data and inform you about the processing(s) for which your personal data is used.

Rectification or erasure of data

If it appears after access that the personal data La Force International  processes of you are not (completely) correct, you can request rectification. You can also ask La Force International to delete your data. La Force International will implement this request, unless there are compelling, e.g., legal, obstacles to doing so. La Force International will inform you about whether or not a rectification or data erasure has been made.

Restriction and objections

You always have the right, due to your specific situation, to object to the processing and to request La Force International to restrict or discontinue the processing. If there are no compelling obstacles, for example legal obstacles, La Force International will honor your request. La Force International will notify you of its decision.

Right to object to Automated decision making

At La Force International personal data is not subject to automated decision making.

Right to Data Portability

You have the right to obtain and reuse your personal data for your own purposes across different services.

La Force International will respond to your request as soon as possible and you will receive an answer no later than 30 days from sending in your request.

To identify you with regards to exercising your rights we need certain a copy of your identification card, passport or driver’s license. The following information needs to be blocked (crossed out).

  • Picture

  • Document number

13. Questions – complaints

If you have a question or a complaint about the processing of your personal data by La Force International, please let us know. La Force International will respond to your question or complaint as soon as possible, but at latest within four weeks.

14. National Data Protection Authority

You also have the right to lodge a complaint with your national privacy regulator, in the country you live in.

15. Changes to the privacy policy

La Force International may amend this privacy statement at any time with the latest revision made on the 1st July 2020. New versions are always published on the website. La Force International recommends that you periodically review this statement to ensure that you are kept informed of any changes.
